Alex has a broad commercial practice, with a particular interest in corporations (including insolvency, directors' duties, oppression, derivative actions), banking and finance, property, and construction matters.
He is regularly briefed to appear and advise in all Victorian courts and tribunals and the Federal Court, both led and unled. Alex appears in trial, appellate and interlocutory hearings (e.g., injunctions, freezing orders, summary judgment, security for costs, amendment).
Alex holds a Bachelor of Laws and Bachelor of Science from Monash University and a Master of Laws from the University of Melbourne.
Some cases in which Alex has recently appeared include:
- Insolvency: acting for and against liquidators in various proceedings including under Part 5.7B of the Corporation Act and remuneration determinations, setting aside and resisting applications to set aside statutory demands, claims for breach of directors’ duties, applications for court-appointed receivers (including remuneration).
- Real and personal property: proceedings involving claims for equitable interests in property including proprietary estoppel, resulting and constructive trusts, caveat removal applications, recovery of land, easement disputes, commercial and retail leases, claims in bailment and conversion, negligence.
- Building and construction: SOPA claims, arbitration, domestic building disputes.
- Banking and finance: enforcing and setting aside loan, mortgage and other security documents (including guarantees and indemnities), claims for unconscionable conduct, misleading and deceptive conduct.
- Equity and trusts: trustee’s indemnity, breach of trustee’s duties, fiduciary duties, breach of confidence.
- Consumer law: breach of contract, statutory guarantees, misleading and deceptive conduct, unconscionable conduct.
- Torts: intentional torts, negligence, defamation.
In addition to his practice as counsel, Alex is a nationally accredited mediator and accepts briefs to mediate in a broad range of disputes, particularly commercial matters.
