Environment & Planning

Our members provide completely independent advice and generally appear in the Planning and Environment List and Land Valuation List of the Victorian Civil and Administrative Tribunal, as well as in matters in the Valuation, Compensation and Planning List in the Supreme Court. In addition, they appear before Planning Panels Victoria and advise on matters that concern the amendment of planning schemes, appear before Heritage Victoria on issues which concern places of cultural heritage significance and appear before other administrative decision makers with responsibility for land use approvals. An environmental barrister also deals with all issues relating to Liquor Licensing.

The development of land can raise matters of great significance in financial, social and other terms. There is a wide range of legislation that defines and affects the right to develop and use land and such legislation is often of a highly technical nature.  It is essential that members of the community have access to the most appropriate legal advice and representation in specialized fields at an early stage in the proceeding.

In addition to Victoria’s planning schemes administered at local government level, our members often need to refer to and consider particular legislation affecting an application to use or develop land. Our members have the professional expertise to advise on the rights of appeal and/or review of various administrative decisions, and to present cases in the best way through early advice. Legislation relevant to Environment & Planning issues can be viewed here.
