Fabian specialises in construction disputes, commercial disputes, property and leasing disputes, and regulatory prosecutions, particularly in trial work involving expert evidence. Fabian enjoys a busy advocacy practice, regularly appearing in complex commercial matters unled.
Fabian's experience includes:
- Construction Disputes: a busy superior court and tribunal practice acting on behalf of builders, property developers, owners, architects, engineers and other trades in respect of defect and delay claims, security of payment act disputes, down-stream sub-contractor disputes and front-end contract advice. Fabian's practice spans both domestic and commercial construction disputes. Fabian also often advises on the trickier aspects of front-end drafting for major building contracts.
- Commercial Disputes: a broad commercial practice including acting in partnership disputes, disputes between company directors, equitable claims (such as misrepresentation and duress), insolvency disputes and international and domestic commercial arbitrations.
- Property & Leasing Disputes: appearing and advising in disputes regarding leases and licences, disposal and sales of property, removal of caveat proceedings, and owners corporation disputes.
- Urgent injunctions: appearing in urgent injunctions in all jurisdictions, such as freezing orders, orders to prevent the transfer of property, to urgently abate property damage, to restrain the use of confidential information, and to prevent the calling upon of securities.
Fabian maintains chambers in both Melbourne and Hobart, is a member of the Tasmanian Bar (his profile can be found here) and regularly appears in all Tasmanian courts.
Fabian sits as a sessional member of the Tasmanian Civil and Administrative Tribunal (TASCAT), is a current member of the Domestic Building List Users Group with VCAT, and has been a member of the Svenson Barristers List Committee since 2019. Fabian read with Tony Horan in 2018.
Prior to joining the bar in Victoria, Fabian was an associate at a large Tasmanian firm. Fabian was also an associate to international arbitrator and the founder of the Singapore International Arbitration Centre (SIAC), Dr Michael Pryles AO. Fabian was a founding board member of the Refugee Legal Service (Tas). In March 2019 Fabian was a finalist in the Lawyers' Weekly 30 under 30 awards in the barrister category.
