Graeme Hill SC practices in constitutional and administrative law. He appears regularly in migration and other general administrative law matters.
Some recent cases which he argued include ABT17 v Minister for Immigration [2020] HCA 34 (review under Pt 7AA of the Migration Act), Meringnage v Interstate Enterprises [2020] VSCA 30 (whether VCAT has jurisdiction to make orders against the Commonwealth) and DKN20 v Minister for Immigration [2021] FCAFC 97 (visa cancellation under s501CA of the Migration Act). Some other cases in which he appeared as junior counsel include Northern Territory v A Griffiths (deceased) [2019] HCA 7 (calculating compensation for extinguishment and impairment of native title rights), Strickland v CDPP [2018] HCA 53 (lawfulness of compulsory examination by ACC and effect on criminal trial), and McHugh v Minister for Immigration (No 2) [2021] FCAFC 152 (estoppel and public law).
Before coming to the Bar, Graeme worked at the Commonwealth Attorney-General’s Department and the Australian Government Solicitor for 12 years. He also worked as counsel assisting the Commonwealth Solicitor-General. In 1997-98 he was associate to Justice Hayne of the High Court.
In 2001 he completed a Master’s degree at Columbia University, specialising in constitutional law. He has published widely on constitutional and administrative law, and is one of the co-authors of the 4th edition of Hanks on Constitutional Law. He took silk in 2021.
