It is with deep regret that the Bar Council informs members of the death last Monday evening, 19 May 2014, of The Honourable Dr Peter Buchanan QC. His Honour was 70 (born, 11 October 1943).

Peter Buchanan was educated at Scotch College and, on the family moving to Canberra, at Canberra High School. He graduated BA and LL B (First Class Honours ranking first in his class) from the Australian National University.

He served Articles with Alan Lobban at Blake & Riggall (now Ashurst) and was admitted to practice on 1 June 1967. He tutored at the Monash Law School for 9 months, before going to the University College London on a scholarship. He largely completed the work on his Ph D thesis in his first year, and was able to spend much of the remaining scholarship years in motor cycle racing in Britain and on the Continent – on the Isle of Man, and in France and Italy. Motor cycle riding was a lifelong passion since high school days.

Dr Buchanan signed the Bar Roll on 9 April 1970 and read with James Gobbo (later a Supreme Court Judge then Governor of Victoria, Sir James Gobbo). He was on Dever’s List. He had many large cases involving complex contract, corporations, trade practices, insolvency and equity issues. He practised extensively in administrative law and constitutional law, and had several criminal cases. He had eight Readers and took silk in November 1984.

Dr Buchanan practised at the Bar for 27 ½ years, of those, just short of 13 years as a silk. On 28 October 1997, he was appointed directly to the Court of Appeal. His Honour served just short of 16 years to statutory retirement.

He was the longest serving Judge of Appeal to date. As the senior puisne Judge of Appeal since 2007, His Honour also sat as Acting President of the Court of Appeal. He was Chair of the Rules Committee; and Judge in Charge of the Civil Appeals Portfolio.

Dr Buchanan’s Funeral Service will be at The Scots’ Church, at the corner of Collins & Russell Streets, Melbourne on Monday 26 May 2014 at 4:30 pm.
