In this CPD, the speakers will discuss the ramifications of the recent Court of Appeal decision in McKenzie v Healthscope Operations [2020] VSCA 309.

Since the decision by Judge Higgins in Perkins v GIO in 1995 it has been generally accepted in Victoria that it was difficult for parties to contract out of the scheme created by the Accident Compensation Act 1985. This CPD discusses whether the underlying premise has been radically altered by this relatively recent Court of Appeal decision.
