Statutory unconscionable conduct – recent developments

Statutory unconscionable conduct is a cause of action that features in regulatory proceedings brought by the ACCC and ASIC, and also in private litigation (including class actions). Its jurisprudence has been expanding in recent times, including through appellate decisions.
