Risky Business: Isles, Eastley, and the elements of Unacceptable Risk

The risk consideration in s 60CC is the most important provision in s 60CC(2). Two Full Court decisions have recently addressed the issue: Isles & Nelissen, and shortly thereafter, Eastley & Eastley.

In this CPD, counsel for the respondent in the appeal of Eastley will address the landscape of unacceptable risk (including the current application for special leave), before turning to the practical elements of making parenting orders where unacceptable risk is alleged.
