Litigating parenting matters without ‘the presumption’ and with the revised ‘best interests test’

On 6 May 2024, the Family Law Amendment Act 2023 will be in effect; the result being a revised Part VII which abolishes the presumption of equal shared parental responsibility, simplifies the s60CC ‘best interest test’ and creates a new enforcement/contravention regime.
This CPD will be Part 1 of a structured panel discussion considering the application of the amendments to the preparation and presentation of parenting cases moving forward. Part 2 to come dealing with the second tranche of amendments concerned with property settlement proceedings.
