Mistakes in contracts: correcting by construction, or reconstruction, without rectification

In a recent series of cases, Australian intermediate appellate courts have been willing to correct mistakes in contracts by construction, or reconstruction, without requiring a claim for rectification to be established. This seminar will consider how this can be done, how it might be preferable to seeking rectification, and, in particular cases, which mechanism might be required or preferable.
