Navigating Australia's complex Assisted Reproductive Technology regimes

Overlapping and inconsistent State and Federal laws present a minefield for clients seeking to complete their families via assisted reproductive technology, surrogacy, and adoption. Same sex parents in particular face unique and high-risk challenges as they are situationally more likely to interact with these regimes.

This session will provide an overview of the current body of law and regulation, survey landmark cases including a High Court decision on who is a parent (Masson v Parsons (2019) 266 CLR 554) and feature a surrogacy case study highlighting risks barristers need to be aware of to adequately advise same sex clients.
