In 1939 Justice "Doc" Evatt delivered a dissenting judgment in the nervous shock case of Chester v Waverly Council. Gideon Haigh examined this judgment in his recent book "The Brilliant Boy - Doc Evatt and the Great Australian Dissent." In 2022 the High Court delivered judgement in Kozarov v State of Victoria. The seminar will explore the development of this area of law.
