Climate change litigation in Australia

Climate change litigation is a fast-growing area of legal practice in Australia and elsewhere around the world. Outside the United States, Australia has the highest volume of climate change cases in the world, and is now an area of legal practice for a growing number of barristers. Climate change litigation encompasses a broad range of matters, including planning and administrative law challenges to new projects, human rights and torts-based claims against governments and companies, corporate regulation (including directors’ duties and Australian Consumer Law contraventions) and other challenges to corporate communication and inaction by companies. Civil matters include claims for compensation for the impacts of government climate change policy on business. It also encompasses criminal law.

In this CPD presentation, the speakers will discuss the following topics:

•  An overview of climate change litigation in Australia, with reference to some key foreign domestic and international law decisions;

•  Recent and emerging themes in Australia and globally in climate change litigation; and

•  Particular issues arising in climate change litigation.
