Class Closure Orders in 2022 (post-Haselhurst and Boral): Principles and Practice

The CPD will give a historical understanding of the approach of the courts to the recurring issue of ‘closing’ open class actions, and examine recent developments in principles and practice following the decisions of the Court of Appeal of the Supreme Court of NSW in Haselhurst v Toyota Motor Corporation (2020) and Wigmans v AMP Ltd (2020), and the decision of the Full Federal Court in Parkin v Boral Ltd (Class Closure) (2022). 

The CPD will also explain different models of ‘class closure’ and the timing of when ‘class closure’ may occur in the progress of a class action.
