Barnes v Addy and beyond: revisiting claims against accessories to breaches of trust and fiduciary duty

Breaches of trust or fiduciary duty can occur in the lead up to a company failing (or a person becoming bankrupt), often in the form of misdirections of company or trust funds or assets. In such cases, insolvency practitioners may do well to examine whether there are third parties who may be liable as accessories.

This presentation aims to provide practical guidance for practitioners about bringing Barnes v Addy claims and related claims, on the present state of the law. The presentation will provide an overview of elements of the claims, along with discussing several interesting points on which the law remains unsettled.
