This presentation will discuss recent developments, emerging trends, legislative changes and caselaw updates from 2022 in Australian Consumer Law focusing on:
- the digital economy: including an update on the ACCC’s focus on deceptive advertising and marketing practices, and an analysis of the findings in Viagogo v ACCC [2022] FCAFC 87;
- unfair contract terms: including the recent amendments to the Competition and Consumer Act 2010 (Cth) and the ASIC Act 2001 (Cth); and
- the increased penalty regime: including a discussion of the ACCC’s recent increase in seeking maximum penalties for contraventions of the Act, the High Court decision in ABCC v Pattinson [2022] HCA 13 and the Federal Court in ACCC v Trivago N.V. (No 2) [2022] FCA 417.
