Habeas Corpus and Immigration Detainees

Two recent judgments have opened the way to habeas corpus being granted for those in immigration detention. This seminar will explore those cases: NZYQ concerning those who cannot be removed from Australia and McHugh concerning Australian Aboriginal people. It will explore the strategy and considerations legally relevant to pursuing a claim for habeas corpus.
