Community Safety Orders - Immigration Detainees

In response to the High Court’s landmark decision in NZYQ, a new Community Safety Orders (CSO) regime was introduced in December 2023, allowing for Courts to order the continued supervision or detention of former immigration detainees who are deemed to pose a risk of sexual or violent reoffending. The regime is modelled closely on the existing federal regime under Div 105A of the Criminal Code (Cth) that allows for post-sentence orders (PSOs) for terrorist offenders. This session will address the introduction of the CSO regime and how it compares to the PSO regime under Div 105A. The session will be delivered in a hybrid format, with participants welcome to attend remotely via livestream.
