Lindy practises predominately in commercial litigation, but also has experience in common law matters (particularly personal injury) and public inquiries.
Lindy has appeared in the Supreme (including Appeals), County and Magistrates' Courts in Victoria, as well as the Federal Court, VCAT and various Royal Commissions.
Lindy's practice includes: - a broad range of commercial disputes, such as:- general contractual matters; - partnership, shareholder and trustee disputes; - sale of business disputes, including restraints of trade; - consumer protection claims, including misleading and deceptive conduct claims; - general insurance matters, including professional negligence claims; - property litigation, including retail lease disputes; - banking and finance, particularly mortgage and guarantee litigation; - insolvency matters ranging from bankruptcy to liquidators' claims - large scale fraud recovery matters (including obtaining search and freezing orders); and - environmental litigation, and in particular claims made under s62(2A) of the Environment Protection Act 1972.
- general negligence claims, including personal injury matters (both statutory benefits and common law claims), as well as class actions; and
- Royal Commissions. Most notably in 2009 to 2010, in the Victorian Bushfires Royal Commission and 2013 to date, in the Royal Commission into Institutional Responses to Child Sexual Abuse.
Immediately before joining the Bar, Lindy was a Senior Associate at Herbert Geer & Rundle (now Thomson Geer), in the Commercial Litigation Group.
