Solomon Islands Bar Association Tsunami Relief Fund

As you would no doubt be aware, last Monday, the Solomon Islands experienced a major earthquake followed by a tsunami of significant proportions. These events resulted in significant loss of life and widespread devastation.  Help is needed.

Resignation of the CEO

The Chief Executive Officer Ms Christine Harvey has informed the Bar Council of her intention, to resign effective from 5 April 2007.  She plans to continue her active involvement in the professions.

The Bar is very grateful for the service Christine has given as CEO since starting in October 2004.  She took up office at a time of considerable change in the staffing of the Bar Office and was effective in introducing systems to the office that saw it operate more efficiently. 

She also oversaw from the Bar’s perspective the introduction of the Legal Profession Act 2004 which came into operation on 12 December 2005.  This involved considerable challenges to the Bar in adapting to the changed environment of the Bar no longer assuming a direct regulatory role.

Christine has been invaluable in representing the interests of the Bar at the Law Council of Australia, the Australian Bar Association and other national and state legal bodies.   With that in mind, the Bar has retained Christine on a consultancy contract basis to provide further representational services to the Bar for at least the remainder of 2007.

The Bar thanks Christine for her significant contribution to the Bar and wishes her well in her new endeavours.

Review of the Process of Appointment of Senior Counsel

On 22 February 2007, the Bar Council unanimously resolved to confirm its support for the current process of appointment of senior counsel by the Chief Justice.

The Bar Council has resolved to proceed with an independent review of the staffing and management of the Bar office and the governance of the Bar to be completed no later than the end of March 2007.

"I refer to Karen Kissane’s article in Saturday’s Age, Is there justice for all?, and her follow-up piece in Tuesday’s Age, Without truth, justice can’t be done.

One aspect of the initial article requires comment.  Stephen Shirrefs SC was quoted as commenting on the questions barristers consider in deciding whether to take a brief.

The Rules of Conduct which bind all Victorian practising barristers and have the force of law provide expressly that save in prescribed circumstances, a barrister must accept a brief from a solicitor to appear before a court, to advise or to draw pleadings or any other document in a field in which the barrister practises or professes to practise.

This is the “cab rank” principle which is fundamental to the way Victorian barristers practise, and to the role of an independent Bar in the administration of justice.  In observing the principle, the Bar has provided representation to thousands of clients whatever the popularity or merits of the cause they wish to advance."

The Bar - What should we be about?... and David Hicks

The Bar Council has begun a process of settling on a strategy for the future of the Victorian Bar. 

Strategy documents can sometimes be pious statements of good intention, but short in specific insightful analysis of where an organization should be heading, and for what purpose.  Without a strategy, the organization can drift, buffeted by the winds of change this way and that, and react to events rather than head with a sense of purpose in a particular direction...

Recent comments by the Federal Attorney-General have raised the question of the proper role of a professional association of lawyers – should the association focus on their particular profession rather than on social policy to avoid what he calls the risk of “the professional equivalent of imperial overreach”?  The Attorney also distinguishes what he calls “fashionable issues” that are “issues of personal political conviction not professional solidarity”.

Appointment of Silk

The Chairman has released the following statement to the press in response to recent and ongoing publicity:

"The Bar takes great pride in the recent appointments of Senior Counsel.

The Chief Justice engaged in significant consultation and the Bar is very supportive of her role.  The Chief Justice has said she expects to continue to develop the process of consultation and the Bar keeps an open mind on ways best to do that."

Ms Mei-Leng Hooi appointed Senior Manager of the Bar

I am pleased to announce that the Bar has appointed Mei-Leng Hooi Senior Manager of the Bar.  Mei-Leng starts today in her new role and will be known to many at the Bar, as she previously worked at LexisNexis as the Account Manager for Victorian barristers.  More recently she worked with the ANZ as Rewards Manager - Loyalty Programs, Credit Cards Australia.

Mei-Leng will be responsible for the overall management of staff, projects and initiatives to improve process for the Victorian Bar and will report to the Chief Executive Officer, and to the Bar Council as required.

The CEO, Christine Harvey will continue in her present role but with greater focus on –
(a)    the strategic direction of the Bar;
(b)    participation in, and co-ordination and oversight of, the preparation of policy submissions on issues relating to the law and to Victorian barristers;
(c)    representation of the Victorian Bar on allocated committees and projects;
(d)    provision of timely and accurate advice to the Chairman to assist him/her in carrying out the Chairman’s representational and leadership responsibilities.

 

David Belson retires from the Bar

David Belson retires on Thursday 30 November after a career of more than 33 years specializing in crime and personal injuries work.  David signed the Bar roll on 15 November 1973 and read with Jack Winneke as he then was. He has been a member of the Foley’s List Committee for many years.

He has always been generous in the support and advice he has given to junior members of the Bar and we will miss him greatly.  On behalf of the Bar, I wish David a long and satisfying retirement.
