It is with deep regret that the Bar Council informs members of the death of Malcolm Robert Titshall KC on Thursday 17 November 2022 at the age of 73 years.

Mal was a leading member of the Common Law Bar Association and the Dever List. He was gifted advocate particularly before a Jury and always presented a carefully conceived and prepared case with flair and, when appropriate, great vigour. He was renowned for his high impact cross examinations.

Whilst Mal had, to significantly understate it, a strongly competitive approach to trials, it must be emphasised that he was scrupulously fair and true to his word. He had conspicuous contempt for those that fell short of his standard of propriety and was a member of the Ethics Committee of the Bar from 22 June 2007 until 4 February 2016.

Mal obtained his qualifying degrees at Monash University, did his Articles at Best Hooper and read with the late Tony Hooper QC.

He mentored 4 readers – Geoffrey Martin, Mark Gibson, Clarke Grainger and Ragini Rajadurai.

Mal was diagnosed with pancreatic cancer 2 years ago. It was a particularly severe form of the disease, and the oncological prognosis was commensurately bleak: “…get your affairs in order … 2 months”.

Mal reacted with great determination. He chose to fight and did so with bravery and without at any stage taking a backward step.

He beat off his aggressor over a long period and in so doing confounded medical learning and experience. He was able to lead a remarkably active life until a few weeks prior to his passing.

Mal is survived by his beloved and wonderful wife Joanne, children Kate, Michael and Ben and 8 grandchildren.

His memorial service will be held at St Andrews Church Brighton at 3:00pm on Friday, 25 November 2022.
