Recommendation 80 - Guidance in relation to the duty of confidentiality

Following the Royal Commission into the Management of Police Informants (RCMPI), the Commissioner made a number of recommendations. Recommendation 80 of the RCMPI Final Report requires:

“That the Victorian Bar, within 12 months, prepares guidance in relation to the duty of confidentiality and its exceptions, including: a. the factors to be considered when assessing whether a disclosure of confidential information is justified b. where and how a barrister can obtain advice on ethics when considering making a disclosure c. steps to be taken to document the actions taken by a barrister regarding the information received and the disclosure made d. any further actions that a barrister should take when considering making a disclosure.”

In response to Recommendation 80, criminal law barristers, Peter Chadwick QC, Colin Mandy SC and Jason Gullaci will deliver a lecture for members focused on the duty of confidentiality.
