Recent High Court cases on damages

This presentation will consider two recent High Court cases dealing with damages under the Australian Consumer Law: Moore v Scenic Tours Pty Ltd [2020] HCA 17 (damages for distress for breach of consumer guarantees in the context of a ruined holiday) and Berry v CCL Secure Ltd [2020] HCA 27 (damages for misleading and deceptive conduct where unlawful means were used to secure an outcome). The ramifications of the decisions for the broader law of remedies will also be considered.
