Outcomes of the summit - In Australia the jury decides: assessing the reliability and validity of expert evidence

The Victorian Chapter of the AAFS has been working to lift the profile of issues around the use of expert evidence in our courts since its revitalization in 2010. In November 2019, the Chapter held a Summit at which leaders and decision makers in their respective disciplines discussed how the validity and reliability of expert evidence is best assessed, assured and adduced into evidence. 

Discussion was focused particularly on whether there is a problem with the way the reliability and the validity of expert evidence is evaluated in the courts and whether a change of approach is justified. Participants agreed that a review of our uniform evidence laws in relation to expert evidence was desirable. This presentation will present the outcomes of that summit and the way forward.
