Guarantees:  Overview and Current Issues in Enforcement

This seminar will look at the formal requirements for drafting guarantees, pleadings, and outline the scope of guarantor liability and discharge, guarantor rights and defences, and legislation affecting guarantors.  In light of the recent decisions in Asset Flooring v North [2016] 49 VR 813, and Webster Investments v Anderson and North Star Developments [2016] VSC 620, the panel will explore contribution between guarantors, as well as the circumstances in which equity will relieve a guarantor of liability.
