The question of remedies for voidable transactions is sometimes complicated, occasionally contentious, but readily overlooked.

This session will explore differing approaches to remedies in corporate insolvency and in bankruptcy – and highlight some nuances of which practitioners may be unaware. The session will provide practical guidance (through various hypothetical scenarios) as to options available to plaintiffs seeking to recover the property the subject of the impugned transaction itself, or relief from individuals who have dealt with the property.
