Equitable Principles and Mortgagee Rights

The third in a series presented by the Victorian Reports, this seminar will cover some recently reported commercial cases dealing with the interaction between principles of equity and mortgagee rights — one dealing with the role of subrogation where a second-ranking mortgagee pays out a loan owed by a debtor to a first-ranking mortgagee, and two others (at trial and on appeal) concerning the doctrine of 'marshalling by apportionment'.
