The "security of payment" reforms via the Building and Construction Industry Security of Payment Act 2002 (Vic) continue to dominate the landscape of construction law practice and debate. During the past year, the enactment of similar Acts around Australia, along with continuing detailed judicial scrutiny, has made engaging with the legislation an increasingly-complex task. Matthew will review the history, purpose and key features of the Act in order to give context to these recent developments and also to attempt to foresee what the future might bring in this vital area of construction law contracting and dispute resolution.
