BHP Billiton financier allowed bad debt deductions The Full Federal Court has upheld a decision that the taxpayer, which was the internal financier for the BHP Billiton Group, was entitled to a deduction under the bad debt provisions, s25-35 of the ITAA 1997, for just over $2bn in loans made to 2 other members of the Group for mining projects that failed. Tax Laws Amendment (Transfer of Provisions) Bill 2010 The Tax Laws Amendment (Transfer of Provisions) Bill 2010 has been introduced in the House of Reps. It proposes to rewrite a number of provisions formerly in the ITAA 1936 into the ITAA 1997 and TAA 1953, including Part VI collection & recovery provisions; Schedule 2C commercial debt forgiveness; Schedule 2E luxury car leases; Schedule 2G farm management deposits and Schedule 2J general insurance. more

Commissioner refused leave to amend statement of facts, issues & contentions The Federal Court has refused the Commissioner leave to amend his Statement of Facts Issues and Contentions by adding an alternative basis for his claim that the payments in question were assessable receipts under s28(b)(i) of the Petroleum Resource Rent Tax Assessment Act 1987.
