Taxpayer appeals in Pt IVA case The taxpayer has appealed to the Full Court against the decision of Emmett J in British American Tobacco Australia Services Ltd v FCT [2009] FCA 1550, where the Federal Court dismissed the taxpayer's appeal and upheld a $118m Pt IVA assessment made by the Commissioner as a result of the global merger of the British American Tobacco group of companies and the Rothmans International group of companies. more

Government refuses to release Henry tax review early In a statement made to the Senate toady, the Assistant Treasurer informed the Senate that the Government will not release the final report of the Henry tax review at this stage, despite the Return to Order motion passed by the Senate yesterday, which required the report's production by no later than 9.30am today. more

Income on transfer of land to be calculated at date of transfer The Federal Court has affirmed that the amount of ordinary income derived by a taxpayer in relation to a parcel of land transferred to him should be calculated based on the market value at the date of transfer. No input tax credit on purchase of residential property The Federal Court has affirmed that a taxpayer was not entitled to claim an input tax credit for the acquisition of a house where the taxpayer's intention was to redevelop the site into 10 units. Two appeals to the Full Court The Commissioner has appealed to the Full Court against the decision of Ryan J in Ashwick (Qld) No 127 Pty Ltd & Ors v FCT [2009] FCA 1388, where the Federal Court upheld claims by companies in the Foster's Group for bad debt and interest deductions totalling just over $2.78 billion. The taxpayer has appealed to the Full Court against the decision of Logan J in Russell v FCT (No 2) [2009] FCA 1469, where the Federal Court did not answer the question of whether a court has the power to remit a matter to the Commissioner to increase a disputed assessment. more

No reduction of penalties for incorrectly claimed input tax credits The AAT has affirmed a decision of the Commissioner to deny a further reduction of a 5% shortfall penalty imposed on a corporate taxpayer who incorrectly claimed input tax credits (ITCs).
