Alternative Dispute Resolution

The Victorian Bar has arranged a scheme to provide services in the area that is often called alternative dispute resolution. The scheme offers the services of barristers at the Bar's Mediation Centre at 180 William Street Melbourne.

The resolution of disputes has traditionally been the work of the courts. Some disputes can be resolved only by a court but litigation may not be the best way and therefore the parties to a dispute need to select the best way of resolving it. An alternative method of dispute resolution, out of court, may better suit the parties' needs.

The aim of the Victorian Bar Dispute Resolution Scheme is to provide parties with the opportunity of resolving a dispute privately, quickly, cheaply and with the least disruption to personal relationships. That aim will usually be achieved if full-scale litigation can be avoided and the fees paid to an arbitrator or mediator will have been worthwhile.

Barristers as accredited mediators

In our community, barristers have day-to-day experience in the presentation and resolution of disputes. The Bar has accredited mediators who have undergone special training to receive accreditation from the Bar Council. They will usually have a particular expertise, in one or more specialised areas of law and practice. Since April 2006 the Bar has invited accredited mediators with the requisite skills and experience to apply to become advanced mediators.

The Victorian Bar is the professional organisation of barristers who are in private practice. It is promoting this scheme so that the services of its members can be made available directly to parties who need to resolve a dispute.

Those appointed are completely independent. They work alone. Their only aim is to resolve a particular dispute or assist the disputants in that regard.
